Terms of Service

Actify is jointly developed and operated by Hustler Inc LLC (Portland, Oregon, USA) and Byteonica AI Technologies Private Limited (Jaipur, Rajasthan, India), collectively "we," "us," or "our." By using Actify ("the App"), you agree to these Terms. If you do not agree, do not use the App.
1. Account Registration
You must create an account to use Actify. You agree to provide accurate information, keep your password secure, notify us immediately of unauthorized access, and accept responsibility for all activity under your account. We may suspend or terminate accounts that provide false information or violate these Terms.
2. Description of Service
Actify helps you search and track job applications, tailor resumes and cover letters using AI, automate job application workflows, track interviews by parsing emails from a connected account, and manage your professional profile.
3. Subscription and Billing
Plans. Actify offers free and paid plans. Paid plans unlock advanced AI processing, unlimited job tracking, and automation.
Payment. A third-party processor handles billing. By subscribing, you authorize recurring charges at your selected interval (monthly or annually).
Cancellation. Cancel any time in App settings. Access continues until the end of the current period. Fees are non-refundable except as stated below or required by law.
EU / UK Withdrawal. EEA and UK consumers may withdraw from a subscription within 14 days of purchase. Using a paid feature within that window constitutes a request for immediate performance and waives the remaining withdrawal right. To withdraw, email actify@actify-ai.com with your account email and a withdrawal statement. Refunds are issued to the original payment method within 14 days.
Price Changes. We give 30 days notice before price increases. Continued use after the effective date is acceptance. Cancel before that date if you disagree.
Failed Payments. If a charge fails, we may suspend paid access and retry. Sustained non-payment may result in subscription downgrade or termination.
4. AI-Generated Content
Actify uses third-party AI providers to generate resume content, cover letters, job summaries, and career guidance. AI output may contain errors. You are solely responsible for reviewing everything before submitting it to employers or third parties. AI output is not professional career, legal, or financial advice, and we make no warranty it will improve employment outcomes.
5. Automation Features
Actify can automate actions on third-party platforms (job boards, professional networks) using your credentials or session data. By enabling this, you accept responsibility for compliance with those platforms' terms. We are not liable for account suspensions or bans resulting from automated activity, and automation may break when platforms change their interfaces.
6. Email Account Access
Connecting an email account grants Actify permission to access it via IMAP to identify job-related emails, extract interview dates and recruiter contacts, and populate your tracking dashboard. We do not access emails unrelated to job searching and do not store raw email content on our servers. Revoke access any time in App settings.
7. Beta Features
Features labeled "beta," "preview," or "experimental" are provided as-is, may be changed or removed at any time, and may behave unpredictably. Use them at your own risk. We may use your feedback without obligation or compensation.
8. Your Content
You own all data you provide ("Your Content"). You grant us a non-exclusive, royalty-free license to process Your Content solely to deliver the App, including sending it to third-party processors as described in our Privacy Policy. This license ends when you delete Your Content or close your account, except where retention is required by law. You warrant you have the right to submit Your Content and that it does not infringe third-party rights.
9. Prohibited Uses
You may not use Actify to violate any law; submit false or fraudulent applications; impersonate others; infringe third-party rights; circumvent security controls; reverse engineer or decompile the App; scrape or extract App data beyond normal use; damage our infrastructure; or resell or sublicense access.
10. Copyright Complaints
To report copyright infringement, email actify@actify-ai.com with: your signature; the copyrighted work and the infringing material; your contact details; a good-faith statement that use is unauthorized; and a perjury statement confirming accuracy and authority. We may remove infringing content and terminate repeat infringer accounts.
11. Third-Party Services
Actify depends on third-party providers for infrastructure, payments, AI models, and similar services. We are not responsible for their acts, omissions, or availability. See our Privacy Policy for how data flows to these providers.
12. Intellectual Property
All rights in the App (excluding Your Content) are jointly owned by Hustler Inc LLC and Byteonica AI Technologies Private Limited, including software, design, trademarks, and documentation. You receive only the limited license to use the App. The App includes third-party open-source software; attribution texts are available within the App.
13. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, THAT AI OUTPUT WILL BE ACCURATE, OR THAT JOB SEARCH OUTCOMES WILL IMPROVE.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER HUSTLER INC LLC NOR BYTEONICA AI TECHNOLOGIES PRIVATE LIMITED SHALL BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA LOSS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF FEES YOU PAID IN THE PRIOR 12 MONTHS OR USD 100. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS; IN THOSE PLACES OUR LIABILITY IS LIMITED TO THE MINIMUM EXTENT PERMITTED.
15. Indemnification
You will indemnify and hold harmless Hustler Inc LLC, Byteonica AI Technologies Private Limited, and their respective officers, employees, and affiliates from claims, damages, and expenses (including legal fees) arising from your use of the App, breach of these Terms, or infringement of third-party rights.
16. Force Majeure
We are not liable for delays or failures caused by events outside our reasonable control, including natural disasters, war, government action, labor disputes, power or internet outages, third-party service failures, or cyberattacks.
17. Termination
We may suspend or terminate your account at any time with reasonable notice, immediately in cases of serious violations. You may delete your account any time in App settings. Sections 8–20 survive termination.
18. Changes to Terms
We will notify you of material changes at least 14 days in advance via in-app notification or email. Continued use after the effective date is acceptance. If you disagree, cancel and stop using the App.
19. Governing Law
These Terms are governed by Oregon law. Disputes are resolved exclusively in the state or federal courts of Multnomah County, Portland, Oregon. This does not limit rights you have under mandatory laws of your country, including India's IT Act 2000 and DPDP Act 2023, the GDPR (EEA/UK), or the CCPA (California).
20. General
Entire Agreement. These Terms and our Privacy Policy are the complete agreement between us regarding the App.
Assignment. You may not assign these Terms without our consent. We may assign them to an affiliate or successor with notice.
No Waiver. Failure to enforce any provision is not a waiver. Waivers must be in writing.
Severability. If any provision is unenforceable, it is modified minimally to become enforceable; the rest remains in effect.
Notices. We notify you via app, email, or our website. Notices to us must be in writing to the addresses below.
